Vietnam revealed second draft amendment to decree on chemicals regulated under Chemical Weapons Convention

On May 5, 2023, the Ministry of Industry and Trade of Vietnam (MOIT) published the second version of the second draft amendment to the Decree No. 38/2014/ND-CP on the Management of Chemicals Governed by the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction (hereinafter “the Draft”). The Draft proposes to: clarify the definition of designated chemical substances, revise existing provisions on the production of designated chemical substances as set forth in the Chemical Weapons Convention, to introduce new provisions on exemptions from obtaining trade licenses and import/export permits according to the concentration thresholds, introduce provisions on storage and use of such chemicals, and unify the deadlines for submission of different reports. A number of changes have also been made to the first version of the draft amendment, which was published on June 9, 2022. The Draft was open for comments until May 31, 2023.
