Indonesia Regulates Import of B2 Hazardous Substances, Chemicals and Mineral Resources

On June 30, 2025, Indonesia’s Ministry of Trade promulgated the “Ministerial Regulation No. 20 of 2025 on Import Policies and Regulations for Chemicals, Hazardous Substances and Mineral Resources”, which will take effect 60 days after its promulgation. The regulation requires importers of certain hazardous chemicals and mineral resources to obtain various permits and licenses, comply with specific regulatory conditions and submit import performance reports.

 

Regulated items containing hazardous substances (commonly referred to as B2 substances) include:

  • Lubricant base materials
  • Cement clinker and cement
  • Rough diamonds
  • Non-pharmaceutical precursors
  • Petroleum and natural gas
  • Nitrocellulose (NC)
  • Commercial explosives
  • Ozone-depleting substances (ODS/BPO)
  • Hazardous substances (B2)
  • Hydrofluorocarbons (HFCs)
  • Specific chemical substances (BKT)

 

The term hazardous substances (B2) is defined as substances, whether in singular form or mixtures, which may directly or indirectly harm health or the environment, and which exhibit toxicity, carcinogenicity, teratogenicity, mutagenicity, corrosiveness, and/or irritant properties. These substances are listed in Annex I, Items No. 95 through No. 192.

While specific chemical substances (BKT) are not formally defined, the following three items are designated in Annex I:

  • 213: Sodium tripolyphosphate (STPP) (technical grade) (HS 2835.31.90, CAS RN 7758-29-4)
  • 214: Formic acid (HS 2915.11.00, CAS RN 64-18-6)
  • 215: Lysine (feed-grade) (HS ex 2922.41.00, no CAS RN mentioned)

 

Regulatory conditions, required permits, and designated ports of entry vary depending on the substance. Refer to Annex I of the original regulation for details. Required permits include, but not limited to:

  • Business Identification Number (NIB)
  • Import Approval Letter (PI)
  • General Importer Identification Number (API-U): for registered importers (IT) who import specific items for sale or transfer
  • Manufacturer Importer Identification Number (API-P): for manufacturer importers (IP) who import specific items for use in their own production processes
  • Surveyor’s Report (LS)

 

Importers intending to bring in lubricant base materials or cement for export purposes are exempt from obtaining permits or fulfilling other regulatory obligations, provided the goods will undergo processing, assembly, or installation within Indonesia.
