Vietnam: Results of the National Assembly Standing Committee’s Deliberations on the Draft Amendment to Law on Chemicals

On June 4, 2025, during the 46th session of Vietnam’s National Assembly Standing Committee, key points regarding the draft amendment to the Law on Chemicals (hereafter referred to as “the draft law”) were explained, debated, and reviewed for possible revisions.

 

Revisions and Additions to the Draft Law

As a result of deliberations, the following modifications and supplementary provisions were introduced:

  • A new provision on digital transformation was added, integrating regulations on the chemical sector’s specialized database from previous versions of the draft law to ensure a comprehensive and inclusive legal framework.
  • Specific ministries and their responsibilities were left unnamed, with the government tasked with establishing a separate policy on the role distribution among relevant ministries and local-level People’s Committees.
  • The requirement for organizations and individuals to submit reports to regulatory authorities was removed. Instead, only an obligation to update information in the chemical sector database was included, aiming to simplify administrative procedures in accordance with Central Resolution No. 57-NQ/TW.

 

Strengthening Chemical Substance Management

The draft law also introduces new provisions to enhance the management system throughout the lifecycle of chemical substances:

  • Strict management regulations were added to ensure consistency and coherence in handling chemical substances from their production or import phase through to disposal, based on their classification within the target chemical substance list.
  • A regulatory framework was established for inspection measures on the import and storage services of specially controlled chemical substances.
  • In trade activities involving specially controlled chemical substances, digital technology and digital transformation (DX) will be utilized to cross-check transaction data against registered information from relevant parties. The government will determine the schedule for implementation.
  • Businesses using specially controlled chemical substances must register their usage purposes and required quantities in the chemical database. Additionally, post-use monitoring and verification mechanisms will be strengthened to prevent improper usage.
  • Chemical vendors must ensure that specially controlled substances are sold only to individuals or entities who have pre-registered their name and intended use in the database.

 

Implementation Date and Additional Considerations

The draft law maintains January 1, 2026, as its effective date. However, the provision concerning business certification for chemical substance storage services is proposed to be effective from July 1, 2026, allowing sufficient time for institutional preparation.
