Philippines Issues Implementing Rules of the New Government Procurement Act

On February 4, 2025, the Philippines approved the Implementing Rules and Regulations (IRR) of the New Government Procurement Act (NGPA). The regulations were officially promulgated on February 10, 2025, and came into force 15 days later. These rules were established to implement the NGPA and aim to enhance transparency, competitiveness, efficiency, fairness, accountability, participatory procurement, sustainability, and professionalism in government procurement. Notably, Rule XII (Sections 72–77) specifically lays out provisions for Sustainable Public Procurement (SPP).

 

Sustainable Public Procurement

  • Section 72.1 requires all procurement entities (government agencies) to develop and implement Sustainable Public Procurement programs. The Government Procurement Policy Board (GPPB) will issue guidelines on sustainability standards applicable to all procurement activities. Key priority areas include energy, water, and material efficiency, waste reduction, and pollution prevention.
  • Section 74.1 tasks the Department of Trade and Industry (DTI) with promoting efficient certification programs for green products to foster the domestic green market.
  • Section 75.3 integrates social considerations into public procurement standards, focusing on:
    • Compliance with human rights and fundamental labor standards
    • Promotion of local employment and expanded job opportunities for marginalized communities
    • Training programs for individuals facing challenges in labor market participation
    • Other social and community benefits
  • Section 75.7 directs the GPPB to advance guidelines ensuring active participation of women-led or women-owned enterprises in public procurement.
