On 13 January 2026, the draft Decree detailing a number of articles and measures to organize and guide the implementation of Resolution No. 253/2025/QH15 on mechanisms and policies for national energy development for the 2026–2030 period was published for public consultation.
The draft Decree introduces several regulations and procedures for the development of offshore wind power projects.
Regulations on eligibility conditions for surveying entities and enterprises preparing dossiers for approval of investment policy for offshore wind power projects
The draft supplements a number of criteria regarding the capacity of survey-proposing entities and enterprises preparing dossiers for approval of investment policy, in order to ensure that offshore wind power projects are implemented by capable and reputable investors.
For survey-proposing entities:
- Having a minimum charter capital of VND 5,000 billion;
- Having directly invested or contributed capital to the development of at least one (01) energy project (with a total investment capital of not less than VND 10,000 billion) that has been put into operation (within the most recent five (05) years), in which the entity’s capital contribution accounts for at least 5% of the total investment capital of the project; or having carried out at least one of the following activities: project management or construction of an offshore wind power project;
- The above conditions shall not apply to consultancy entities providing survey services for offshore wind power projects, except where such entities directly conduct the survey activities themselves.
For enterprises preparing dossiers for investment policy approval
- Having a minimum charter capital of VND 5,000 billion;
- Having equity capital of not less than 20% of the total investment capital for each proposed offshore wind power project (excluding capital already disbursed for projects under implementation and other long-term financial investments).
Mechanism for handling costs of survey activities and preparation of dossiers for investment policy Approval
In cases where a wholly State-owned enterprise (Enterprise A) is assigned to conduct survey activities:
- Where Enterprise A has conducted the survey but does not participate in project implementation: The investor shall reimburse Enterprise A for the entire survey cost within thirty (30) days from the date on which it is approved as the project investor.
- Where Enterprise A has conducted the survey and contributes capital to the project within the surveyed area: Co-investors shall reimburse Enterprise A for the survey costs in proportion to their respective capital contribution ratios as specified in the dossier for approval of the investment policy, prior to being approved as project investors.
- Where the project is not implemented: Such costs shall be accounted for as production and business expenses of Enterprise A.

Conclusion
The draft Decree gradually addresses existing difficulties and inconsistencies in the implementation of offshore wind power projects, thereby paving the way for private sector participation in investment and accelerating the implementation of offshore wind power projects in line with national renewable energy development policies.
