Indonesia’s Government Regulation on Energy Efficiency fully revised for the first time in 14 years

On June 16, 2023, the Government Regulation No. 33/2023 on Energy Conservation ("the Regulation" or “Regulation No. 33/2023”) was promulgated in Indonesia. Except for some provisions, the Regulation came into effect immediately. The Regulation mandates to implement energy conservation regulations in Indonesia, specifically providing for (i) conservation of energy resources and (ii) improvement of energy usage efficiency. The provisions on (ii) improvement of energy usage efficiency also refer to implementation of energy audits in factories and introduction of energy conservation standards for electrical products. The Regulation is immediately subordinate to the Law on Energy (No. 30/2007) and replaces Government Regulation No. 70/2009. However, it should be noted that provisions of Regulation No. 70/2009 that do not conflict with the Regulation will remain effective.
