On March 19, 2025, Taiwan’s Ministry of Environment announced the “Voluntary Product Carbon Footprint Management Regulations” and the revised “Greenhouse Gas Certification and Verification Bodies Management Regulations.” Both regulations will be implemented from the date of announcement.
To promote and expand the application of carbon footprint system, the “Climate Change Response Act,” promulgated on February 15, 2023, included additional provisions related to carbon footprints. These provisions stipulate that the central competent authority will announce the target products (Article 37, Paragraph 1) and the regulations for carbon footprints of products other than the announced products (Article 37, Paragraph 2) separately.
Based on Article 37, Paragraph 2, the “Voluntary Product Carbon Footprint Management Regulations” were established. These regulations outline the procedures for manufacturers, importers, and sellers of products other than those designated by the Ministry of Environment under Article 37, Paragraph 1, to submit applications for product carbon footprint certification.
Alongside the establishment of the “Voluntary Product Carbon Footprint Management Regulations,” the revised “Greenhouse Gas Certification and Verification Bodies Management Regulations” were also announced. The revised regulations include additional provisions related to the inspection of product carbon footprints.
According to the Ministry of Environment, in the coming future, related rules and target products will be announced in accordance with Article 37, Paragraph 1 of the Climate Change Response Act.
Overview of the “Voluntary Product Carbon Footprint Management Regulations”
- Provisions of the Higher Law
Article 37 of the “Climate Change Response Act,” the higher law, stipulates that manufacturers, importers, and sellers of products other than those announced by the central competent authority can submit applications for product carbon footprint certification. The related rules are to be stipulated by the central competent authority (Ministry of Environment). The “Voluntary Product Carbon Footprint Management Regulations” were established based on these provisions.
- Procedure for Product Carbon Footprint Certification Application
- Confirm the applicable product category rules (apply the rules published by the Ministry of Environment or apply for review of product category rules and apply the approved rules).
- Calculate the carbon footprint based on ISO 14067, product category rules, and specified emission factors.
- Obtain an inspection declaration issued by an inspection body.
- Upload the required documents to the designated platform to apply for product carbon footprint certification.
- After certification, display the label on the product as specified.
The label to be displayed is specified in the appendix of the regulations as follows:
To prevent greenwashing and unauthorized label display, actions such as displaying the label without certification will be subject to fines ranging from NT$10,000 to NT$1,000,000 under Article 54, Paragraph 2 of the Climate Change Response Act.
