India Introduces EPR on Used Oil Starting April 2024

India’s Ministry of Environment, Forest and Climate Change has notified the Hazardous Other Wastes (Management and Transboundary Movement) Second Amendment Rules, 2023 on September 18, 2023. This amended regulation amends the Hazardous and Other Wastes (Management and Transboundary Movements) Regulations 2016 and added the extended producer responsibility (EPR) for used oil. The EPR will impose new obligations on producers, importers, bulk generators, collectors and recyclers of used oil, base oils and lubricants. Meanwhile, an EPR certificate transaction system will be introduced to allow producers and importers to offset their recycling obligations. This amendment is scheduled to come into effect on April 1, 2024.
