China’s FAQs on customs clearance, declaration of hazardous chemicals, dangerous goods

On July 27, 2022, China’s customs published Q&A on the customs declaration of hazardous chemicals on its official account of WeChat. Below are the details.

About determining if a chemical requires a declaration as a hazardous chemical —

For example, when importing cinnamon oil, its HS code 3301294000 is not a code of a hazardous chemical, but do we need to determine if it should be treated as a hazardous chemical based on its properties?

You determine if a chemical is a hazardous chemical or not according to the 2015 List of Hazardous Chemicals. Cinnamon oil is not a hazardous chemical.

Note:
Substances on the above list are subject to inspection as required by the Announcement on the Inspection and Oversight of Imported and Exported Dangerous Goods and their Packaging (General Administration of Customs Announcement No. 129 of 2020).

What information on dangerous goods do we have to provide for the customs clearance of imported hazardous chemicals? Consignees or their agents have to provide the following information:

  • Hazard classification
  • Packaging classification (not required for goods without packaging)
  • UN number of dangerous goods
  • Dangerous goods packaging labels of the UN (UN packaging code; not required for goods without packaging)
Do dangerous goods that are not on the 2015 List of Hazardous Chemicals require statutory inspection at the customs office when imported? Dangerous goods that are not on the list do not require statutory inspection at the customs office when imported.

However, the packaging of dangerous goods exported under the Law on the Inspection of Imported and Exported Goods is subject to performance assessment and use assessment.

What information do we need to declare when we import hazardous chemicals? When you do the declaration for imported dangerous goods, you have to provide the following things:

  • Statement of the suitability of the company for importing hazardous chemicals
  • For goods containing an inhibitor or a stabilizer, the names, amounts and other information on the inhibitor or stabilizer added
  • Chinese labels (not required for goods without packaging) and the SDS written in Chinese
