On July 21, 2020, the Ministry of Industry and Trade (MOIT) of Vietnam consulted the draft “National Technical Regulation (QCVN) on the limits of total lead in paints”. The draft technical regulation stipulates the lead content, testing methods and management of paints manufactured, imported, used and distributed in Vietnam.

Management provisions
The proposed technical regulation sets out the following control provisions for covered paints:
- Manufacturers and importers of the paints shall comply with this draft and related regulations.
- Manufacturers and importers of the paints shall label their paints in accordance with the “Governmental Decree No. 43/2017/ND-CP on product labeling” before their distribution.
- For domestically manufactured paint products, a conformity assessment shall be carried out. Sample testing, manufacturing process evaluation, on-site inspection, etc. are regulated in Annex 2, Part V of the “Circular No. 28/2012/TT-BKHCN on declaration of conformity and methods of conformity assessment”.
- Also, for imported paint products, a conformity assessment shall be carried out. Sample testing, evaluation of commodity lots, etc. are specified in Annex 2, Sub-Item VII of the Circular No. 28/2012/TT-BKHCN.
- Before the paint is put on the Vietnamese market, the paint shall be labeled with the conformity mark (see below) in accordance with the provisions of the Circular No. 28/2012/TT-BKHCN.
- Prior to import custom clearance for the paints, the quality of the paints shall be inspected by a laboratory designated by the MOIT.
