Vietnamese authority conducts questionnaire survey on implementation of chemical regulations

On April 12, 2021, the Vietnam Chemicals Agency (Vinachemia) under the Ministry of Industry and Trade (MOIT) issued a notice regarding a questionnaire survey on implementation of Law on Chemicals (No. 06/2007/QH12) (hereinafter “the Law”) and its subordinate regulations towards companies carrying out chemical related activities. The questionnaire has 27 questions as indicated below:

  1. Chemical-related activities that the respondent company carries out
  2. Frequencies of collection of information or updates regarding the Law and its subordinate regulations
  3. Methods of collection of information or updates regarding the Law and its subordinate regulations
  4. Necessity to strengthen propaganda and popularization of the Law and its subordinate regulations by competent authorities
  5. Feasibility of the current provisions of the Law and its subordinate regulations
  6. Appropriateness of the scope and subjects of application of the Law
  7. Appropriateness of the terminology in the Law and subordinate regulations
  8. Appropriateness of the requirements for production and trade of chemicals
  9. Appropriateness of the requirements for equipment and technologies related to production, trade, portioning, packaging, and use of chemicals
  10. Necessity for the special requirements for production and trade of chemicals
  11. Appropriateness of the requirements for the production and trading of 1) industrial chemicals subject to conditional production and trading; and 2) industrial chemicals restricted from production and trading
  12. Assessment of the current regulations on control of industrial chemicals restricted from production and trading
  13. Assessment of the application documents for 1) certificates of eligibility for chemicals subject to conditional production and trading; and 2) the licenses for production and trading of industrial chemicals restricted from production and trading
  14. Assessment of the mandated dossier and procedures for exporting and importing industrial precursors
  15. Assessment of the current regulations on the use of chemicals to produce other products or goods
  16. Assessment of the current regulations on storage and preservation of chemicals
  17. Assessment of the implementation of regulatory declaration of imported chemicals using the National Single Window (NSW)
  18. Assessment of different lists of chemicals
  19. The current status of implementation of the regulations on classification and labeling of chemicals at the respondent company
  20. The current status of implementation of the regulations on sales management sheets for toxic chemicals at the respondent company
  21. The current status of implementation of the regulations on prevention and response to chemical incidents at the respondent company
  22. The current status of implementation of emergency drills against chemical incidents at the respondent company
  23. Assessment of various formats of documents stipulated for developing measures and plans to prevent and respond to chemical incidents
  24. Difficulties in implementation of administrative procedures related to permission or license for chemicals
  25. The current status of chemical-related reporting activities at the respondent company
  26. Difficulties in implementation of the Law and subordinate regulations
  27. Comments or suggestions to the Government, MOIT or Vinachemia related to the implementation of the provisions of the Law and its subordinate regulations
