On July 4, 2026, the Vietnamese Government issued Decree No. 272/2026/NĐ-CP guiding the implementation of Resolution No. 253/2025/QH15 on mechanisms and policies for national energy development for the 2026–2030 period. This Decree is effective from July 4, 2026, through December 31, 2030. The Resolution provides detailed regulations on several notable aspects regarding offshore wind power development and power grid investment projects:

- Eligibility requirements for enterprises and application documents for approval of investment policies for offshore wind power projects;
- Approval of investors for power grid investment projects.
Eligibility requirements for entities conducting surveys for offshore wind power projects
A survey entity is an organization requesting the allocation of a marine area for surveying purposes to support the development of an offshore wind power project.

Conditions for enterprises preparing the dossier to request approval of the investment policy for an offshore wind power project
- Have equity capital of no less than 20% of the project’s total investment capital and a commitment to secure financing for the remaining portion;
- In cases where the enterprise is a foreign investor or an economic organization with foreign investment:
- Involvement of a state-owned enterprise or an enterprise in which a state-owned enterprise holding 100% of the charter capital holds more than 50% of the charter capital or total voting shares; and the proportion of charter capital or total voting shares in the economic organization implementing the project is ≥ 5%
- There is a written consensus opinion from MOD, MPS, and MOFA.
- A commitment to use domestic suppliers for labor, goods, and services.
- The investment capital contribution ratio in the project is ≥ 15%.
- In the case of a domestic enterprise with no foreign investor as a member or shareholder, the investment capital contribution ratio must be ≥5%.

Thus, Decree No. 272/2026/ND-CP contributes to improving the legal framework for offshore wind power development. The Decree establishes strict regulations regarding the conditions and financial capacity required of entities conducting surveys and investing in offshore wind power. These requirements will help enhance project transparency and feasibility while screening for investors’ actual capabilities. At the same time, the requirement to commit to using domestic suppliers’ labor, goods, and services will promote the participation of Vietnamese businesses, thereby gradually developing the supply chain and domestic capabilities for the offshore wind power sector.
