2026 OSH Law Reform in Vietnam 
On July 27, 2026, the Ministry of Justice published the Appraisal Dossier for the draft Law on Occupational Safety and Health (Amended) on its official portal for public consultation. Amending the 2015 Law on Occupational Safety and Health (OSH) toward the 2026 milestone is not merely a legal text update, but an urgent imperative under the administration of the Ministry of Home Affairs—the authority performing state management over labor, wages, and social insurance under the new model specified in Decree No. 25/2025/ND-CP.
Strategic Importance of the OSH Law Amendment
The Law on Occupational Safety and Health No. 84/2015/QH13 was passed by the 13th National Assembly on June 25, 2015, and took effect on July 1, 2016. After nearly 10 years of implementation, alongside positive results, practical law enforcement and changes in related legal systems (such as the 2019 Labor Code, 2024 Law on Social Insurance, and 2025 Law on Inspection) have created an urgent requirement to amend the OSH Law to:
- Consolidate Political Perspectives: Institutionalize Directive No. 31-CT/TW of the Secretariat on strengthening Party leadership over OSH work, placing prevention at the core.
- Synchronize the Legal System: Ensure full compatibility with new statutes, such as the 2024 Law on Social Insurance, the 2023 Law on Medical Examination and Treatment, and, in particular, the 2024 Data Law, to support digital governance.
- Elevate International Standards: Domesticate commitments under ILO Conventions 155 and 187 to create a competitive advantage for Vietnamese enterprises in global supply chains.
