Vietnam Vietnam enacts decree on administrative penalties for violations in chemical field

In Vietnam, on August 30, 2019, the “Government Decree No.71/2019/ND-CP on administrative penalties for violations in the field of chemicals and industrial explosives” was enacted. This decree sets penalties and fines, and corrective measures for each violation in the fields of chemicals and industrial explosives.

Maximum fines under this decree are the following:

  • Violations by individuals in the field of chemicals can be fined up to VND 50 million.
  • Violations by individuals in the field of industrial explosives can be fined up to VND 100 million.
  • In the case of violations by organizations, its maximum fines will be twice as much as fines imposed to individuals.

This decree came into effect on October 15, 2019, and the following Governmental Decree   became invalid accordingly:

  • Governmental Decree No. 163/2013/ND-CP on administrative penalties for violations in the field of chemicals, fertilizers, and industrial explosives
  • Governmental Decree No. 115/2016/ND-CP on amendment and supplement of the Governmental Decree No. 163/2013/ND-CP
