On January 12, 2021, China’s State Administration for Market Regulation released the “Measures for the Administration of Cosmetics Registration and Notification”, which will take effect on May 1, 2021. The Measures were enacted based on “Regulations on Cosmetics Management and Supervision” released in June 2020.A summary of the Measures is as following.
Scope of Application
It applies to the registration, notification, management and supervision activities of cosmetics and new raw materials for cosmetics in China.
Conditions for registrants and notifiers
- A company or other organization established under the law.
- An appropriate quality management system for registration and notification of chemicals
- The ability to monitor and assess adverse effects of cosmetic products.
In case the registrant or notifier is a foreign enterprise
If the registrant or notifier is a foreign enterprise, it shall designate an enterprise corporation in China as the domestic responsible person, and the domestic responsible person shall carry out the obligations of registration and notification.
Notification Management
Before the “general cosmetics” be launched or imported, the notifier shall submit the notification data through the information service platform in accordance with the requirements of National Medical Products Administration. The notification will be completed after the submission of date.
Registration Management
Before producing or importing “special cosmetics”, the applicant for registration shall submit application materials in accordance with the requirements of National Medical Products Administration.

“Regulations on Cosmetics Management and Supervision” stipulate that “special cosmetics” are subject to “registration management” and “general cosmetics” are subject to “notification management. “Special cosmetics” are defined as “cosmetics that declare new efficacy such as coloring, perming, blemish removal/whitening, sunscreen, hair loss prevention. Cosmetics other than “special cosmetics” are all classified as “general cosmetics”. |
Safety Monitoring System
The safety monitoring period is 3 years from the completion of registration or notification of cosmetics using new raw materials. Every year, the registrant or notifier shall analyze the use and safety status of the new raw materials and submit an annual report to National Medical Products Administration.
Distinction between Chinese domestic products and imported products
If the last manufacturing process that touches the contents of a cosmetic product is completed in China, it is a Chinese domestic product; if the same process is completed outside China, it is an imported product.
