Malaysia revised order on import prohibition

On January 7, 2022, the Customs (Prohibition of Imports) (Amendment) (No. 2) Order 2022 (hereinafter “the Amendment Order”) was promulgated in Malaysia. The Amendment Order makes amendments to the First Schedule, Part I of the Third Schedule, and Part I of the Fourth Schedule of the Customs (Prohibition of Imports) Order 2017, coming into force on January 10, 2022. Most importantly, the Amendment Order stipulates that waste metal and recovered paper shall be imported to Malaysia in accordance with the guidelines issued by SIRIM Berhad, a standard and industrial research institute wholly-owned by the Malaysian government.

Amendment to First Schedule (Goods which is absolutely prohibited for import)

Importation into Malaysia of goods specified in column (2) of the First Schedule, originating or manufactured wholly or mainly in, or consigned from, the countries specified in column (3) of the First Schedule is absolutely prohibited.

The Amendment Order has inserted the Item No. 16, as shown in the table below, after the Item No. 15.

Amendment in Part I of Third Schedule (Goods which is prohibited to be imported into Malaysia except in the manner provided)

Importation into Malaysia of the goods specified in Columns (2) and (3) of Part I of the Third Schedule that originate in any of the countries specified in Column (4), shall be prohibited, except when imported in the manner specified in Column (5).

The words that are struck through in the table below have been removed by the Amendment Order. (Columns (3) to (5) are omitted in the table below.)

Amendment in Part I of Fourth Schedule (Goods which may not be imported into Malaysia except conforming to the Malaysian Standard or other standards approved by the Malaysian Authorities and in the manner provided)

Importation into Malaysia of goods specified in columns (2) and (3) of Part I of the Fourth Schedule, originating from the countries specified in column (4) of Part I of the Fourth Schedule shall be prohibited, except in the manner provided for in column (5).

The Amendment Order has inserted Item No. 4 “Recovered (waste and scrap) paper and paperboard” and the Item No. 5 “Waste and scrap of metal,” as shown in the table below, after the Item No. 3. To import such goods, it is required to get pre- and post-shipment inspections and get a Certificate of Approval (CoA) issued in accordance with the applicable guidelines.
