Ministry of Labor of Taiwan notices revision of classification of “Priority controlled chemicals”

On June 14, 2021, the Ministry of Labor of Taiwan noticed the revision of “Administrative measures for the priority controlled chemicals designation and handling” and released the revision draft. The deadline for submitting comments is 60 days after the date of draft publication. According to the provisions of “Occupational Safety and Health Act”, when handling chemicals that classified as priority controlled chemicals, it is necessary to apply for and notify the central competent authority and obtain the handling permit. The regulations regarding the classification of “priority controlled chemicals” were amended in this revision, and the main amendments are as follows.

 

Amendments related to the classification of “Priority controlled chemicals”

The classification of “priority controlled chemicals” for which applications and notifications should be submitted has been revised as follows.

Carcinogen Level 2 The concentration (weight percent) is more than 1%, or the total annual handling amount is more than 1 ton. The total annual handling amount is more than 50 tons.
Germ cell mutagenicity Level 2
Reproductive toxicity Level 2

Serious eye injury and irritating substances Level 1
Specific organ system toxic substances (repeated exposure) Level 1

 

The following is a comparison of the contents of Article 2 which is the basis for the above table (Excerpts only for the contents related to the revision, the underline marks the contents revised).

2.Based on the classification of national standard CNS 15030, chemicals classified as carcinogen, germ cell mutagenicity, respiratory allergens Level 1, serious eye injury and irritating substances Level 1, and specific organ system toxic substances (repeated exposure) Level 1 are chemicals designated and notified by the central competent authority.

3. Based on the classification of national standard CNS 15030, chemicals with physicochemical hazards or are harmful to health are chemicals designated and notified by the central competent authority.

2. Based on the classification of national standard CNS 15030, when any of the following situations apply.

1)      Chemicals classified as carcinogen Level 1, or germ cell mutagenicity Level 1 are chemicals designated and notified by the central competent authority.

2)      Chemicals with physicochemical hazards or are harmful to health and the maximum total handling amount has reached the limit specified in the Appendix 2, are chemicals designated and notified by the central competent authority.

  • Carcinogen Level 2, germ cell mutagenicity Level 2, respiratory allergens Level 1, serious eye injury and irritating substances Level 1, and specific organ system toxic substances (repeated exposure) Level 1 are added in the Article 2, Paragraph 2.
