Amendment to Poisonous and Deleterious Substances Designation Order in Japan

In Japan, a decree partially amending the Poisonous and Deleterious Substances Designation Order was promulgated in the Official Gazette on June 24, 2020, and came into force on July 1, 2020. Based on the Poisonous and Deleterious Substances Control Law, the contents of Article 1 “Poisonous Substances” and Article 2 “Deleterious Substances” in the order were amended as follows, and new substances were added to “Poisonous Substances” and “Deleterious Substances” respectively.

The following transitional measures are taken for these new additional substances.

  1. The provisions of Article 3 (Prohibition), Article 7 (Person in Charge of Handling Poisonous and Deleterious Substances), and Article 9 (Change of Registration) of the Poisonous and Deleterious Substances Control Law shall not apply to those newly designated as poisonous or deleterious substances until September 30, 2020.
  2. The provisions of Article 12, paragraphs 1 and 2 of the Law (Indication of Poisonous or Deleterious Substances), shall not apply to newly designated poisonous or deleterious substances that exist on the date of enforcement of the amended Cabinet Order (July 1, 2020) until September 30, 2020.
