Vietnam Promulgates Decree Mandating Environmental Protection Fees for Exhaust Emissions

On November 21, 2024, Vietnamese Ministry of Natural Resources and Environment (MONRE) promulgated Decree No. 153/2024/ND-CP Stipulating Environmental Protection Fees for Exhaust Emissions (hereafter “the Decree”). The Decree establishes provisions for environmental protection fee, including facilities subject to the mandatory payment, method of calculation, fee collection authorities, required declaration, and payment procedures. This Decree has been formulated in accordance with Article 4, Paragraph 6 of the Law on Environmental Protection 2020 (72/2020/QH14), which states "operators who cause pollution shall bear the responsibilities.” The Decree adopts a similar policy to the Decree No. 53/2020/ND-CP on Environmental Protection Fee for Wastewater, where environmental protection fees vary depending on the total amount of pollutants discharged. The Decree will enter into force on January 5, 2025.
