Singapore publishes multiple legislations for beverage container return scheme

On July 11, 2024, six legislations were published in Singapore regarding the beverage container return scheme, which is scheduled to be implemented from April 2025 under the Resource Sustainability Act 2019. The legislations clarify the requirements for operators of Producer Responsibility Schemes that collect and recycle empty beverage containers on behalf of producers, as well as the beverage containers that will be subject to the regulation.

 

Resource Sustainability (Amendment) Act 2023 (Commencement) (No. 2) Notification 2024

The notification provides that Sections 2, 3(a), 6, 8, 9, and 10(b) of the “Resource Sustainability (Amendment) Act 2023” shall become effective July 12, 2024.

Section 6: Provides for beverage container return scheme as Part 4B.

 

Resource Sustainability (Beverage Container Return Scheme (BCRS) Ltd. — Exemption) Order 2024

The order provides for the exemption of Beverage Container Return Scheme (BCRS) Ltd. from Section 17 of the Resource Sustainability (Producer Responsibility Scheme) Regulations 2021 until December 31, 2024.

Resource Sustainability (Beverage Container Return Scheme) Regulations 2024

The regulations provide that beverage containers subject to the beverage container return scheme is made of plastic or metal and have a volume of 150 ml to 3,000 ml.

 

Resource Sustainability (Exemptions from Part 4B) Order 2024

The order provides that producers of beverage products are exempt from Section 23V of the Resource Sustainability Act 2019 until March 31, 2026.

Resource Sustainability (Producer Responsibility Schemes) (Amendment) Regulations 2024

The regulations specify requirements for operators of Producer Responsibility Schemes for beverage containers.

 

Resource Sustainability Act 2019 (Amendment of Schedule) Order 2024

This regulation adds “any empty beverage container of a beverage product within Part 4B” to the schedule of the Resource Sustainability Act 2019, which specifies waste subject to Producer Responsibility Schemes.
