Korea to revise Regulations Concerning Preparation, etc. of EIA Reports and Enforcement Decree on EIA Act

South Korea Ministry of Environment issued an administrative notice on proposed partial revision of the Regulations Concerning Preparation, etc. of Environmental Impact Assessment Reports, etc. from October 12 to November 1, 2022. The revision is intended to supplement and improve the current regulations by simplifying the area category of ecological area ratio and considering new environmental policies such as carbon neutrality when conducting environmental impact assessment. On the other hand, for the Enforcement Decree on the Environmental Impact Assessment Act, a draft decree for partial revision is on legislative notice from October 27 to December 6, 2022. It will improve problems that have surfaced in the operation of environmental impact assessment system so far, such as adjusting the criteria for small-scale environmental impact assessment targets and clarifying the targets of change consultation, taking into consideration the characteristics of projects, the degree of environmental impact, and fairness.
