South Korea promulgates partially revised OSHA regulations on MSDS required substances related to CBI

On September 27, 2023, the Ministry of Employment and Labor of South Korea promulgated the latest revision of the Enforcement Rules of the Occupational Safety and Health Act (OSHA). The revised rules reduce burdens on companies regarding Material Safety Data Sheet (MSDS) preparation and submission. Specifically, when a company manufactures any of substances that are subject to the MSDS requirement (hereinafter “MSDS-required substances”) domestically or abroad using substances that already have obtained “non-disclosure approval” for confidential business information (CBI), or imports any of such MSDS-required substances, the MSDS may refer to and/or use the information included in the non-disclosure approval already obtained.
